A year after a car accident, I began receiving notices from the Center for Medicare & Medicaid Serves (CMS), itemizing my medical expenses and reminding me of “Medicare’s priority right of recovery.” Clueless, I called our family attorney. She suggested I contact another lawyer, Gary Poole, an attorney in Chapel Hill who handles automobile and motorcycle personal injury cases. This proved to be an excellent referral.

The CMS mailings provided no hint that I might be eligible for additional compensation for other expenses – past and future – or “pain and suffering.” Gary questioned me about the accident, injuries and medical treatment. (My case involved two vertebra breaks). Among complicating factors: my husband, insured under the same GEICO policy, was the driver; and I’d had previous lumbar issues and surgery. Gary explained the CMS form letter, my legal options and available evidence. He clearly knew the law, what might be expected, and the paperwork to be assembled. Gary advised that in my scenario it would be in my best financial interest for me to continue to handle the case on my own with the insurance company, but that he would help me along the way. We had numerous telephone consultations, with Gary coaching me on exactly what to say to the insurance adjuster, and when. As a result of his strategizing, in addition to some $6,000 in CMS, GEICO eventually agreed to pay more than double that amount for pain and suffering, etc.

As bodily injury cases go, this was a small and iffy case. But over the course of two months, Gary returned phone calls quickly, listened attentively, brainstormed freely, advised with authority, and emboldened my negotiations. On February 10th my wife was involved in an automobile accident. A young gentleman crossed over into her lane and hit her head on.
